Dear Commissioner Lancaster:

I URGE YOU TO IMMEDIATELY REINSTATE THE STOP-WORK ORDER FOR 360 WEST 11TH STREET AND TO REVOKE THE PERMITS FOR THE PLANNED 110-FT TALL RESIDENTIAL TOWER ATOP THE EXISTING BUILDING THAT WOULD VIOLATE THE NEW ZONING FOR THE AREA. 

I am outraged that the Department of Buildings has decided to reward a law-breaker and drop the stop work order for this site and allow this development to move ahead, in direct contradiction to how community leaders and our elected officials were told this case was going to be handled.  As you know, many neighbors of this site called 311 to report regular and ongoing illegal, after-hours work here leading up to the change in the zoning for the area.  Such behavior indicated that the owner, Mr. Schnabel, was seeking to “beat the clock” and finish his foundations in time to be allowed to complete his project, regardless of the legality of the work. 

As you also know, these complaints of illegal after-hours work were for the most part not inspected by the Department until days or weeks later, and sometimes not at all.  Now the Department is suddenly claiming that it must drop the stop-work order because there is no proof of the illegal work, when the lack of proof is a direct result of the Department’s failure to respond to multiple legitimate complaints in a timely manner.  This is an insult to all New Yorkers who seek to play by the rules and obey the law.  This sends a chilling message to all fair-minded New Yorkers, while encouraging unscrupulous developers to simply sidestep the law as needed to get the rulings from the Department they want. 

THERE IS NO REASON TO ALLOW A DEVELOPMENT THAT VIOLATES THE NEW ZONING FOR THE FAR WEST VILLAGE, AND WHICH SEEMINGLY ONLY ATTAINED THE REQUIRED COMPLETED FOUNDATIONS THROUGH ILLEGAL, AFTER-HOURS WORK, TO CONTINUE.  PLEASE REVOKE THE WORK PERMITS FOR 360 WEST 11TH STREET RIGHT AWAY.
