Re: BSA Variance Application 299-12-BZ, 40-56 10th Avenue, Manhattan

Dear Chair Srinivasan and Members of the Board:

I strongly urge you not to grant the increased floor area requested by the applicant in this case.  The bulk allowed by the zoning is already quite generous, and the 34% increase being requested would be out of character for the neighborhood.

The applicant claims to face a hardship, but has clearly not demonstrated that one exists.  Other developments have been built in the immediate vicinity with very similar conditions on their sites at the size allowed by the zoning.

Rather than seeing the presence of the High Line on the lot as a hardship, it should be understood to be a tremendous economic boon for the developer.  The High Line’s presence increases the value and desirability of the development to be built there enormously, and more than outweighs any difficulty imposed by having to build around it.
