Proposed rule change on challenges to building permits

The Department of Buildings (DOB) has proposed a new system for considering challenges to their granting of permits for new buildings based upon zoning compliance (i.e. size, height, and allowable uses in a building). Groups like GVSHP frequently challenge DOB permits on the basis of proposed new buildings being too tall, too big, or including uses not allowed under zoning.

The new system would formalize the procedure for challenging DOB decisions and require that building diagrams be posted on-line. However, the system would also create a very brief 30 day window after which DOB would not have to consider challenges to building permits, even if the planned development clearly violates the zoning, and require members of the public to monitor the DOB website to know when such permits have been approved. The new system also does not include several other reforms needed to make the permit challenging process truly even-handed and accessible to the public. Also, while DOB is holding a hearing on the rule change this Friday, they plan to implement the new rule the following Monday.
