Dear Chair Srinivasan:
I strongly support the appeal of the Department of Buildings’ decision to allow the transfer of development rights from the Cooper Station Post Office (#238-06-A).
Because Post Offices are not subject to NYC zoning regulations, allowing this air rights transfer makes no sense whatsoever. There is nothing stopping the Post Office from using these “transferred” air rights again. The only entity which would have any power to try to prevent the Post Office from doing so is the private owner who purchased the air rights, and there is no guarantee that they will seek to stop them. This is an unacceptable removal of the responsibility for enforcing zoning regulations from a public entity, the Department of Buildings, to a private one. This sets a terrible precedent and leaves all neighborhoods vulnerable to increased overdevelopment.
I urge you to rule against the Department of Buildings in this case as soon as possible. The dorm is going up very quickly as we speak, and thus it is imperative that the BSA rule soon before the project is completed.
